Tapada do Falcão - Booking conditions
Contract
If you make a booking with us your contract will come into existence
when we dispatch a written confirmation and account. The lead member
of the party accepts these booking conditions on behalf of all persons
in their party. A list of their names and ages (if under 18) should
be provided at the time of booking or if not known then, at the
latest two weeks prior to the start date of the holiday property
rental. Your contract with us will be governed by English law and
is subject to the exclusive jurisdiction of the courts of England
and Wales.
Payment
In order to confirm your booking a deposit of one third of the total
amount due must be paid at the time of booking, or the full amount
if within 8 weeks of the start of the rental period. If we do not
receive all the payments due in full and on time, we reserve the
right to treat the booking as cancelled by you.
Cheques should be made payable to Mrs R J Atkinson (who acts as
agent for Tapada do Falcao - Sociedade Vitivinicola, Lda).
Security deposits/Cleaning fee
We do not require a general security deposit, but reserve the right
to charge for any losses, breakages or damage caused to the property
or contents during your stay. If there are any charges you will
be expected to reimburse us within 14 days of being notified. Minor
damage or breakages will not normally be charged for but you should
replace any breakages prior to departure. We do charge a one-off
cleaning fee of £60 (Tapada do Falcão) or £25
(Casa do Outeiro), and this is payable with the final balance on
your holiday.
If you have elected to have a Portuguese mobile telephone a deposit
of £150 will be payable. This, less call charges, will be
refunded once we have received the relevant bill from the telephone
service provider. This can take up to nine weeks.
Cancellation
Should you need to cancel your booking you must notify us in writing.
Your notice will only be effective once it is received by us. The
following cancellation charges, as liquidated damages, apply as
a percentage of the total cost of your booking:

In the unlikely event that we have to cancel your booking for any
reason other than a default in payment, we will make a full refund
of all monies paid together with compensation, as liquidated damages,

Insurance
We strongly recommend that you take out personal travel insurance
for all members of your party. As well as medical insurance this
should include personal liability protection and holiday cancellation
cover.
Force Majeure
We cannot accept liability or pay any compensation where the performance
or prompt performance of our contractual obligations is prevented
or affected by “force majeure”. In these Booking Conditions,
“force majeure” means any event which we or the suppliers
of the service in question could not, even with all due care, foresee
or avoid. Such events may include war or threat of war, civil strife,
terrorist activity, industrial dispute, natural or nuclear disaster,
fire, adverse weather conditions and all similar events outside
our control.
